Gamesay is free and built to be quoted. Most of what follows exists to make quoting it safe for you and honest about us: what the number means, what you may do with it, what it cannot be used to claim, and how to get one corrected. Using the site means accepting these terms.

1. Who you are agreeing with

These terms are between you and Gamesay ("we", "us"), and they govern gamesay.org and everything on it. We are not a registered company; there is no separate legal entity or office address to disclose. Questions: info@gamesay.org. If you are using Gamesay for an employer or client, you confirm you may accept these terms for them, and "you" means both of you.

If you do not accept these terms, do not use the site. Our Privacy Policy forms part of them.

2. The service

Gamesay publishes one measure — Conversation Volume — for the video games it tracks, updated daily, free, with no account required. It is offered as it is, for as long as we choose to offer it. We may change what is measured, which titles are tracked, how pages look, or stop publishing entirely, at any time and without notice. We do not promise the site will be available, and we do not commit to a publication schedule.

Beta

While the site carries a beta label, the figures, the tracked set and the definitions are still being validated. Treat anything published during beta as provisional in every respect, and do not rely on it in work that matters without checking with us first.

3. What the number is

This section is part of the agreement, not description. If you publish a Gamesay figure, you are publishing something defined here.

Conversation Volume (V) is a score Gamesay publishes for each tracked title, each day. How it is calculated is not published, and nothing in these terms should be read as describing it.

What Conversation Volume is not

GAMESAY IS NOT A SALES TRACKER, NOT A PLAYER-COUNT OR CONCURRENT-USER TRACKER, NOT A SENTIMENT OR OPINION MEASURE, NOT A MEASURE OF AUDIENCE SIZE OR REACH, AND NOT A FORECAST. A change in Conversation Volume does not mean a game sold more, was played more, was liked more, or will do either. Attributing any such meaning to a Gamesay figure is your interpretation, not ours, and section 9 applies to it.

4. What you may do with the figures

We want Gamesay cited. Subject to section 5, we grant you a worldwide, royalty-free, non-exclusive licence to do the following, for any purpose including commercial and editorial:

  • Quote individual Conversation Volume figures, rankings and dates.
  • Reproduce a chart exported from the site, or redraw one from figures shown on it.
  • Include figures in articles, reports, decks, filings, academic work and internal analysis.
  • Read, index and cite the site with automated agents, including AI crawlers and answer engines, to the extent our robots.txt permits. Being answerable by those systems is deliberate.

The one condition: attribution

Every published use must credit Gamesay, state the window the figure covers, and state the through-date printed on the page. A figure without its through-date is not a Gamesay figure, because the same day's count changes as late acts arrive.

Where the medium allows a link, link to the page you took it from. Where it does not, name gamesay.org.

5. What you may not do

  • Reproduce the dataset. The licence in section 4 covers figures you cite. It does not cover systematically copying, downloading or re-publishing the tracked set, the daily series, the rankings or the event timeline, in whole or in substantial part, whether at once or by accumulation over time. Our database rights are reserved.
  • Build a substitute. Do not use the site or its data files to create, train or populate a product, feed, API or dataset that offers Gamesay's figures to others, or that competes with Gamesay.
  • Crawl outside robots.txt, or at a rate that burdens the service. The /data/ files are public so that pages can draw charts; that does not make them an API, and we may rate-limit, block or change them without notice.
  • Circumvent access controls, including any gate on pre-launch or private areas of the site, and any measure limiting access to /_source/.
  • Misstate a figure. Do not alter a figure or chart and still call it ours; do not present a provisional day as settled; do not present a null day as a zero; do not present Conversation Volume as sales, players, audience, sentiment or a forecast; do not strip the through-date.
  • Imply endorsement. Do not suggest Gamesay endorses you, your product, your conclusion or your client, or that we are affiliated with you.
  • Interfere. No attempt to disrupt the site, probe it for vulnerabilities without our written consent, or use it to break any law.

We may withdraw the section 4 licence from a person or organisation that does any of this. Withdrawal does not require us to go to court first.

6. Our own rights, and other people's

The site's design, code, text, charts, brand, logo and the structure and selection of the Gamesay database are owned by us or licensed to us, and are protected by copyright, database rights and trade mark law. Nothing here transfers any of that to you beyond the licence in section 4.

Game titles, developer and publisher names, box art, logos and platform names are the property of their respective owners. Gamesay uses them descriptively, to identify the thing being measured, which is a nominative use and not a claim of any right in them. Gamesay is not affiliated with, sponsored by, endorsed by or connected to any game developer, publisher, storefront or platform, including Twitch, YouTube, Google, Valve, Steam, GOG, CD Projekt, IGDB, Microsoft, Xbox, Sony, PlayStation or Nintendo. Data collected from those platforms is collected from public interfaces, and each platform's own terms govern your own use of it.

If you own a right in something here

If you believe material on Gamesay infringes your copyright or trade mark, write to info@gamesay.org with the material, where it is, what right you hold, and how to reach you. We respond to complete notices and to counter-notices, and we terminate the access of repeat infringers.

7. Corrections

A wrong number is the only failure this site cannot absorb, so the route to fixing one is short. If you are a developer, publisher or reader and you think a figure, a tracked title's details or an event on a timeline is wrong, write to info@gamesay.org with the page, the date and what you believe is wrong.

We will look at it and reply. If we agree, we correct it and the page shows the corrected figure at the next publication. What we will not do is remove or adjust an accurate figure because it is unwelcome: Gamesay counts what was posted, the same rule for every title and every day, and applying the rule differently to one title would destroy the only thing the number has going for it.

Events on a title's timeline are observations with a named source. If the source is wrong, tell us the source; we correct the record rather than the conclusion.

8. The newsletter

Subscribing is optional and free. Every issue carries a one-click unsubscribe. We may change its frequency or stop sending it. What happens to your address is in the Privacy Policy.

9. No warranty, and the limits of our liability

THE SITE AND EVERYTHING ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE FIGURES ARE ACCURATE, COMPLETE, CURRENT OR UNINTERRUPTED.

We build this carefully and we say what we measure, but measurement from public platforms is imperfect: platforms change their interfaces, collection can fail, a source can go dark, and late acts change a recent day.

Not advice

NOTHING ON GAMESAY IS INVESTMENT, FINANCIAL, LEGAL, TAX OR PROFESSIONAL ADVICE, AND NOTHING ON IT IS A RECOMMENDATION TO BUY, SELL OR HOLD ANY SECURITY. Publishers of tracked games are in many cases publicly traded. If you use Gamesay in an investment, trading, valuation, diligence or greenlight decision, you do so entirely at your own risk and on your own analysis, and you are responsible for the regulatory consequences of doing so.

Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GAMESAY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL OR ANTICIPATED SAVINGS, ARISING OUT OF OR CONNECTED WITH YOUR USE OF OR RELIANCE ON THE SITE OR ITS FIGURES, WHETHER IN CONTRACT, TORT OR OTHERWISE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF WHAT YOU PAID US IN THAT PERIOD (WHICH, FOR A FREE SERVICE, IS NOTHING) AND US$100.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, in which case the excluded terms apply to you only to the extent permitted, and everything else in this section stands.

If you are a consumer, these terms do not affect your statutory rights.

10. Indemnity

You will indemnify and hold harmless Gamesay and the people behind it against claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of the site, or your publication or use of a figure in a way section 5 prohibits.

11. Law and disputes

These terms are governed by United States federal and applicable state law, without regard to conflict-of-laws rules.

If you are a consumer resident in the United Kingdom, the European Economic Area or another jurisdiction whose law gives you the right to bring proceedings in your own country and to the protection of its mandatory consumer rules, this section does not take that from you.

Before filing anything, write to info@gamesay.org. Most disputes about a number are disputes about a definition, and section 7 usually settles them faster than a court would.

12. The rest

  • Changes. We may update these terms. The effective date at the top changes with them, and a material change is announced on the home page before it takes effect. Continuing to use the site after that means you accept the new version.
  • Severability. If a provision is unenforceable, it is narrowed to the minimum extent needed, or struck, and the rest stands.
  • No waiver. Not enforcing something once does not waive it.
  • Assignment. You may not assign these terms. We may, to a successor of the business.
  • Entire agreement. These terms and the Privacy Policy are the whole agreement about the site, and replace anything said before.
  • Survival. Sections 3, 5, 6, 9, 10 and 11 survive you stopping using the site.
